1. Who we are, and what these terms cover
Arbiter Defense Group is the d/b/a of ARBR Inc. In these terms, "we", "us", and "our" mean ARBR Inc., and "the site" means the website at arbiterdefense.group.
These terms govern your use of the site. By using it you accept them. If you do not accept them, please leave the site.
2. The site is informational
The site describes our services in general terms so that a prospective client can decide whether to start a conversation. Descriptions are summaries. They may be incomplete, may become out of date, and may change without notice. We give no warranty that anything on the site is complete, current, or applicable to your circumstances.
Nothing on the site is an offer to contract, a quotation, or a commitment that any particular service, capability, or personnel will be available to you.
3. No professional relationship is formed here
Reading the site, sending us an email, and scheduling a consultation are all preliminary steps. None of them creates a client relationship, engages us to provide any service, or places us under any duty to you. We take on work only under a written agreement signed by both parties, and that agreement governs the work.
Nothing on the site is legal advice, insurance advice, or investment advice. Information about protective services is general in nature and is not a substitute for professional assessment of your own situation.
4. Content and marks
The site and its contents, including text, photographs, graphics, layout, and code, are owned by ARBR Inc. or used under license, and are protected by copyright and other laws. The name Arbiter, the name Arbiter Defense Group, and our marks and logotypes are ours.
You may view the site and print or save pages for your own reference. Any other use requires our written permission, including republication, redistribution, commercial use, framing, and systematic copying or extraction of content by automated means.
5. Acceptable use
Use the site lawfully. Do not attempt to gain unauthorized access to it or to any system connected to it, interfere with its operation, probe or scan it, introduce malicious code, or use automated means to harvest its content. Do not misrepresent yourself as us or as connected to us.
6. Third-party links and services
The site links to sites we do not operate, and the contact page embeds a scheduling service provided by a third party. We do not control those sites and services and we are not responsible for their content, availability, or practices. Your use of them is governed by their own terms and policies. A link is not an endorsement.
7. Privacy
What the site collects, and who receives it, is described in the Site Privacy Policy, which forms part of these terms.
8. Disclaimer of warranties
The site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that the site is free of malicious code.
9. Limitation of liability
To the fullest extent permitted by law, ARBR Inc. and its officers, employees, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to your use of the site, whatever the theory of liability. Our total liability for all claims relating to the site is limited to one hundred United States dollars.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
10. Indemnity
You agree to indemnify and hold ARBR Inc. harmless from claims, losses, and expenses, including reasonable legal fees, arising out of your use of the site in breach of these terms or in violation of law.
11. Governing law and venue
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The state and federal courts located in California have exclusive jurisdiction over any dispute relating to the site or to these terms, and you consent to venue there.
12. Changes to these terms
Each version of these terms has its own address. This is version 1, at /legal/terms/v1/. When we publish a new version it gets a new version number and effective date, and the unversioned link at /legal/terms/ resolves to whichever version is current. Superseded versions stay available at their original addresses. Using the site after a new version takes effect means you accept it.
13. General
If any provision of these terms is held unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. These terms are the entire agreement between you and us concerning the site, and they do not alter any signed agreement between us concerning services.
